Lenders have been doing them for years. However, due to the increase in mortgage delinquency due to our current economic situation, the lenders are now overwhelmed with request for short sales. Lenders have been very slow in their response to short sale request. Chase has indicated that they are still working on request made in June, 2009 and we are now closing in on November, 2009.

What's a shortsale?

If you own real property and you owe more on your mortgage then the home would appraise for and you have a hardship, then you may be eligible for a shortsale. In a shortsale, Lenders agree to accept less then what is owed.

In order for your lender to consider this option the following must apply: Property must be listed with a realtor and must have a contract based on the comparables in the area the property is located. Owner must have a financial hardship. A financial hardship could occur from divorce, loss of job, pay cut, illness, accident. etc. Owner's expenses exceed their income, this is considered a hardship. Expenses must be legitimate expenses. One cannot have a $500 dollar a month clothes shopping addiction. Real expenses including; electric, water, rent, insurance, car payments, gas, groceries, homeowner association dues, health insurance, etc.

Once a financial hardship has been established on behalf of the owner, all of the required documents that must be submitted to your lender are below: 1. Bank Statements - Last two months 2. Pay Stubs - Last two pay periods 3. Tax returns for 2008 and 2007 4. W'2s for 2008 and 2007 5. Financial Worksheet

A realtor will provide the following in order to submit to the lender: 1. Listing Agreement 2. Comparables ( active/pending/sold) 3. Listing History 4. Contract offer ( The accepted sales price, should be on or around the current market value) If the contract offer is not acceptable, then the agents should leave the short sale addendum un marked on #5, to allow additional offers to be submitted. But if the original offer submitted is sufficient, this clause should be eliminated.

The following will be provided by the Title company: 1. Title search 2. Preliminary Hud 3. Complete Lien search, including: Code Enforcement, Open Permit and Water balance search.

We highly recommend that a title search and lien search be completed on the property being sold in order to make sure that there are no judgments, liens other than the existing first or second mortgage. If a title search is not completed and a Preliminary HUD -1 Closing Statement is submitted to the lender, which does not reflect other items such as: Code Enforcement liens, Outstanding Water Balances, Open Permits, HOA Liens, Certified Judgments, delinquent real estate taxes, you can get your approval. However, once you have completed your title search and lien search and they show any of the items above, at that point you have to re-negotiate with the lender. In some cases you will not be able to re-negotiate with the lender, so now you have wasted time and energy and you no longer have a deal.

Important Items to consider regarding a short sale: Be careful of large homeowners associations back assessments. Most lenders are not paying the entire amount owed. They are comparing a short sale to a foreclosure in these cases. If a lender proceeds to the foreclosure sale, the lender is, under law, only required to pay a certain portion of the back assessments. This is the rule of thumb to go by, if the property is a condominium, the lender will pay up to 6 months in back assessments, if the property is a single family home, then the lender will pay up to 1 % of the original balance of their mortgage or 12 months of back assessments. Attorney fees are not considered, nor paid for by the lender. In most cases, the HOA will reduce the amount owed to them. However, some HOA's are taking a stance that they will not accept what the lender is offering and they will kill the deal. Most lenders will only accept individual buyers. Most lenders do not allow; Corporations, LLC, LLP, Land Trust, Trust etc. The property must be purchased by an individual person(s). Not all companies who say they can negotiate a short sale are qualified to do so. Negotiating a short sale or even a loan modification requires a background and experience in mortgage, title and real estate. Most short sale negotiators who have a background in title insurance, mortgage, or even real estate have a better idea of the entire process and what is involved in all areas of the short sale transaction. Lenders do not have to approve a short sale, even if there is a hardship; however, most lenders are trying to accommodate the owner to some degree. Lenders will definitely deny owners short sale if they feel there is not a legitimate hardship. Second Mortgage Lenders are asking for 10% of the principal balance. Also, some are advising that they will require the owner to pay the balance due on the second mortgage and they are also holding out for deficiency judgments.

What are the first steps to be taken? First, you'd be advised to make certain that the activity to which you've been subjected does in fact qualify as sexual harassment. The Equal Employment Opportunity Commission states that unwelcome sexual advances, requests for sexual favors or any conduct of a sexual nature is morally wrong, unethical, and unacceptable in the workplace.

The fact that an employee either submits to or rejects such advances cannot be used against the individual as a basis for employment decisions. Furthermore, advances cannot be used to either intimidate or subject the employee to a hostile/offensive work environment. Whether such conduct was intentional or unintentional is of no consequence. These actions will certainly not interfere with your ability to qualify for a lawsuit loan.

Essentially, there are two types of sexual harassment. The first type is "quid pro quo." This form of harassment involves giving something given in exchange for something else. A "hostile work environment" is a second type of sexual harassment that is often found in the workplace. Either one or both would qualify for a lawsuit loan.

Quid pro quo harassment rises in situations in which a basis on which employment decisions are made includes having the employee either submit to reject certain conduct that constitutes sexual harassment. It is unfortunate that many employees feel as though they cannot afford to pursue an action against the harasser, meekly tolerating the egregious conduct. If the harasser intends to create a hostile environment and is successful in doing so, the conduct in which the harasser engages violates the Title VII. Significantly, even if the harasser did not intend to create a hostile work environment, the conduct still may constitute a violation of Title VII.

E-mini S&P futures contract are quarterly like all futures contracts. The monthly identifiers for the E-mini S&P futures contracts are H for March, M for June, U for September and Z for December. The E-mini S&P futures contract trade almost 24 hours per day. However, there is a 30 minute maintenance break in trading from 4:30 to 5:00 PM daily.

In case you lose at the end of the day you are likely to pay in a big way. The margin requirements for E-minis are much less than the normal contract. The day trading margin is less than the margin to hold an overnight position in S&P 500 E-mini Futures contract.

All futures contracts are settled daily. At the end of the trading day they are assigned a final value price. The values of all positions are marked to the market each day after the official close based on the settlement price. Based on how well your positions fared in that days trading session, your account is then either debited or credited. In other words, cash will either come into your account or leave your account based on the change in the settlement price from day to day as long as your positions remain open.

It is this mechanism that brings integrity to the marketplace. As losses are not allowed to accumulate without some response being required, this system gives futures trading a rock-solid reputation for creditworthiness.

Leverage: The effect of price changes is magnified because futures markets are highly leveraged. You typically pay the price in full with stocks (i.e., without leverage) or on margin (50 percent leverage). Leverage can produce large profits in relation to the amount of your initial margin if you speculate in futures and the market moves in your favor. However, you also could lose your initial margin if the market moves against your position.

For example, assume that youve decided to put $10,000 into a futures account. You buy one E-mini S&P 500 index futures contract when the index is trading at 1000. Your initial margin requirement for that one contract is $3,500.

Because the value of the futures contract is $50 times the index, each one-point change in the index represents a $50 gain or loss. If the index increases 5 percent, to 1050 from 1000, you could realize a profit of $2,500= (50 points) ($50). Conversely, a 50-point decline would produce a $2,500 loss. An increase or decrease of only 5 percent in the index could result in a substantial gain or loss in your account in either case. Thats the power of leverage. Similarly a decline would eat up 25% of your original $10,000. It is 71% of your initial margin.

Indeed, leverage is the key distinctive aspect of futures trading as compared with stock trading. It makes your money work harder and produces more in a shorter period of time when everythings going your way, than if you paid for everything in full, up front. In such a situation leverage can be a beautiful thing.

Now suppose you use $5,000 in your account to buy an E-mini S&P 500 contract worth $50,000. However, prices fall by 10 percent instead of going up, and the contracts value drops to $45,000. Your $5,000 is completely gone. This is the dark side to leverage. The person can pay their $15 bill, saving them $80, and still have $85 dollars in their pocket for some fun until the next pay day.

Another big reason that these two options are so difference is the credit reporting. If a person doesn't pay their bills on time it will give their credit report and credit score negatively, making it harder for them to get good financing in the future. Whereas, a pay day loan doesn't go on credit reports or shows up on credit history, and the person is able to pay their bills on time keeping their credit history in tact. How to Get Tax Credits While Saving Future Dollars

Summary: The IRS is giving homeowners incentives to make changes to their homes that will improve energy efficiency. However, these are not without some strings, so make sure you know which you qualify for before you put in the time, effort and money it will take to do these improvements.

The government absolutely wants you to improve your home's energy efficiency, and to that end is offering tax credits for you to do just that. However, only some things you do will qualify for this credit, and strings are attached to those. Even so, if you qualify for these credits, it's certainly a good thing to have.

First, you need to know that energy tax credits can total 30% of expenditures (existing homes only for - windows and doors, metal roofs, insulation, asphalt roofs, ventilating, heating, and air conditioning systems [known as HVACs], non-solar water heaters as well as biomass Stoves) up to $1500 over a 2-year period (tax years 2009 and 2010). The credit is NOT for each year. Further, it is NOT for each adult owner of the home, unless they file separate income tax returns. A husband and wife filing a joint return, for example, could receive up to a single $1500 credit. Two adults (married or living together in the same home) could receive two such credits if they filed separate returns.

Besides that particular tax credit, there are also unlimited and longer-term tax credits totaling 30% of the cost, with no upper limit and good through the year 2016 for new construction and existing homes. This tax credit applies to solar water heaters, geothermal heat pumps, solar panels, small wind energy systems, and fuel cells. The tax credit for fuel cells is limited to $500 for every half kilowatt of power capacity.

Note, too, that installation costs are only allowed for windows, doors, roofs and insulation.

And, to keep the confusion to a dull roar, you can only claim the tax credit for up to what you owe in taxes. Thus, if after other deductions you owe no taxes (even if you had tax payments withheld), you cannot claim the credit. And, if you don't owe enough taxes, you cannot carry over the credit (unless you install the items under "longer term" described above.

The good news is that you can claim both the $1500 credit and the unlimited credit as long as you satisfy the requirements for each.

You will also need to make sure that what you do qualifies for the credit; to do this, it's best to check with the manufacturer or the company you are working with. You should get what's called a Manufacturers Certification Statement that's been signed by the company/manufacturer to certify that it has indeed qualified for the credit. And as with anything in relation to the Internal Revenue Service, make sure you keep documentation -- receipts, the Manufacturers Certification Statement, and anything else you need -- so that you have proof in the event you should be questioned on it.

Form 5695 should be included when you file your taxes, and it should be the latest draft; the energy tax credit appears on line 52 in this form.

Following protracted negotiations the Ministerio Publico Federal (MPF) has granted Brazils North Eastern state of Paraba permission to construct a major new conference centre in the state capital, Joao Pessoa.
